Massachusetts Data Security Regulation Law
The deadline for compliance with this new law has been set as March 1, 2010. It involves the protection of personal information of residents of Massachusetts and establishes minimum standards that must be met in connection with the safeguarding of personal information contained in both paper and electronic records. Personal information is defined as a Massachusetts resident's first name and last name or first initial and last name in combination with:
- Social Security Number
- Driver's License or State Issued ID card
- Financial account numbers

Minimum Standards for Food Establishments
The Massachusetts Department of Public Health will be making an amendment to 105 CMR 590.00, Minimum Standards for Food Establishments, to include Allergy Awareness Requirements for each establishment. The proposed regulation is scheduled to go into effect on July 1, 2010. This will allow time for restaurants to come into compliance by reprinting menus, preparing staff for required training, and other tasks assigned with the regulatory process. Some key points that facilities will be required to adhere to are:
- A poster relative to food allergy awareness must be placed in the staff area
- A menu conspicuously placed which reads, "Before placing your order, please inform your server if a person in your party has a food allergy."
- Food allergy training for all food service staff.

UNUSED DINING MINIMUMS
Recently, there have been NECMA email exchanges regarding how unused dining minimums should be treated for sales tax purposes. A Rhode Island club received information from the Division of Taxation that the unused minimum was not taxable, but a Massachusetts club received information from the Department of Revenue that the unused minimum is taxable. What does your controller or accountant say?
